WHO WE ARE

We are ShiftSouth (Pty) Ltd (trading as SweepSouth), a South African company with our registered offices located at 89 Bree Street, Cape Town, Western Cape, 8000.

Within this Privacy Policy we will refer to this company as “SweepSouth”, “we”, “us” and/or “our”.

OUR POLICY

The purpose of this Privacy Policy is to give you information on how SweepSouth collects and processes your personal information when you use our websites, mobi-sites and software applications and accept any of the services available thereon (collectively referred to as the “Platforms”).

It further informs you of your rights and choices with respect to your personal information and how you can contact us.

Please read this Privacy Policy carefully so that you understand how we treat your personal information. By using any of our Platforms, you confirm that you have read, understood and agree to this Privacy Policy. If you do not agree to this Privacy Policy, please do not use any of the Platforms.

WHAT IS PERSONAL INFORMATION

“Personal information” means any information relating to an identified or identifiable living individual existing juristic person (i.e company) as defined under the Protection of Personal Information Act 4 of 2013 (“POPI”). Depending on who you are and how you interact with us (e.g., telephone, online or offline), we may collect, use, receive, store, analyze, combine, transfer or otherwise process different categories of personal information.

Below is a table reflecting the categories of personal information we may collect about you:

Platform usage and Technical Information:Platform usage, information shared on the Platforms including any in-Platform chat function, technical or other details about any device which you use to access the Platforms, including: internet and/or network connection, your Media Access Control (MAC), any device Unique Device Identifier (UDID) or equivalent; your operating system, browser type or other software; your hardware or mobile device details (including your mobile device type and number and mobile carrier details), IP addresses, time zone setting, geolocation information, content and pages that you access and paths taken on our Platforms and the dates and times that you visit the Platforms or other technical details.
Marketing and Communications InformationCommunication with customer service support, behavioural data (for example, collected using cookies), information about promotions, surveys, competitions, promotional campaigns and records of your decision to subscribe or to withdraw from receiving marketing materials.

Please note that not all of the above information is mandatory however depending on what information is provided by you, will limit the accessibility and functionality of the Platform.

In addition to the above, we may also collect, use and/or share non-personal information or anonymized data such as statistical or demographic data derived from the Platform. The Platforms may use such information and pool it with other information on an anonymised and generalised basis to track, for example, the total number of users of the Platforms, the number of visitors to the Platforms and the domain names of our visitors’ internet service providers.

HOW WE COLLECT PERSONAL INFORMATION

If we receive or collect it from you directly

We collect personal information from you when you voluntarily provide such information, such as when you:

  • register for access as a user to the Platforms and make use thereof;
  • register as a SweepStar or a professional on the Platforms (“Service Provider”);
  • contact us with inquiries,
  • respond to one of our surveys; and
  • enter a competition, promotion or survey or you ask to have marketing materials sent to you.

Wherever SweepSouth collects personal information we make an effort to provide a link to this Privacy Policy.

Collection of personal information from third parties or from publicly available sources

We obtain personal information through third parties, or if publicly available, where permitted by law, including:

  • from our commercial partners in order to provide you with a specific service as offered on the Platforms or through any other means;
  • from third parties who assist us with business operations;
  • from social platforms or networks when you give us permission to do so or such information is available publically as permitted by applicable laws;
  • from third parties within the SweepSouth group of companies, including its affiliates and subsidiaries, subject to applicable laws; or
  • from external reference agencies or third parties in accordance with applicable laws.
  • from publicly available sources, as permitted with applicable laws.

Please be aware that we do not accept unsolicited personal information unconnected with the Platforms and we will delete it as soon as we become aware you have sent us any such Personal (unless we are required to keep that personal information under this Privacy Policy).

You are responsible for any public publishing of information including personal information (for example on a discussion forum). Please remember that this may mean third parties gaining access to that information, for which you will be responsible.

LAWFUL GROUNDS FOR COLLECTING AND PROCESSING YOUR PERSONAL INFORMATION

We process personal information only when we have a valid legal ground to do so. Most commonly, we use your personal information where:

  • it is necessary to process your personal information in connection with the performance of providing you with access and use of the Platforms;
  • it is necessary for our legitimate interests (or the legitimate interests of a third party), as permitted in terms of law;
  • to comply with any legal obligations.

We may seek your explicit consent where the applicable laws require us to do so.

Our use of your personal information and other information

The information collected by Sweepsouth is used by it, it’s subsidiaries and affiliates (the “SweepSouth Related Companies”) in the following ways:

  1. For the successful operation of the Platforms, which includes:
    • the verification, authentication and authorisation of yourself during your onboarding onto the Platform. Further, should you wish to become a Service Provider on the Platform, you will need to be appropriately vetted by SweepSouth. The type of personal information typically required is Identity and Contact information. This is necessary in order for SweepSouth to assess your application.
    • the implementation and monitoring of any bookings which you make using the Platform;
    • the sharing of your personal information in order to carry out any applicable services as provided on the Platform, for example, if, as a user of the Platform, you have booked the services of a Service Provider, we will provide your contact details to the relevant Service Provider in order to enable them to attend service visits, the services, and to contact you if necessary (for example, if the Service Provider is delayed); and
    • the sharing of the Service Providers information with you, for example, we will include the Service Provider’s first name and photograph, and applicable reviews, in their profile on the Platform, which will be available to and searchable by all users of Platform. We will also pass the Service Provider’s full name and telephone number to any user of the Platforms who has booked and paid a deposit for a Service Provider to provide services to them.
  2. To manage and implement the Platform, which includes:
    • ensuring that content from our Platforms is presented in the most effective manner for you and for your computer or other device from which you access the Platform;
    • providing you with information, products or services that you request from us or which we feel may interest you;
    • improving or modifying the Platform, for example based on how you use the Platform and what services you are requesting;
    • calculating conversion rates and other elements of the Platform’s performance;
    • researching and gaining insights into Platforms and market trends and needs and to develop or innovate our technologies, products and services to meet such market trends and needs;
    • analyzing your use of our Platform and compiling internal statistical insights and reports based on data received, for example: In an ongoing effort to better understand and serve the users of the Platforms, SweepSouth conducts research on its user demographics, interests and behavior based on the personal information and other information provided to us. This research will be compiled and analysed on an aggregate basis; and
    • improving and personalizing our relationship with you.
  3. To manage our relationship with you, which includes:
    • carrying out our obligations arising from between you and us;
    • allowing you to participate in interactive features of our Platforms, when you choose to do so;
    • notifying you about changes to our Platforms or services offered;
    • notifying you if there is any interruption of the Platform;
    • receiving your feedback on the improving or developing of our Platforms;
    • providing you with service assistance and problem solutions or to contact or send you notifications related specifically to the Platforms.

OUR DISCLOSURE OF YOUR PERSONAL INFORMATION AND OTHER INFORMATION

SweepSouth is not in the business of selling your personal information or information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your personal information with certain third parties, as set out below.

SweepSouth Related Companies

We may share your personal information within the internal group of SweepSouth. This is in order to:

  • provide support services and technical services to these internal third parties and to receive some of these services from them;
  • contribute to the research, data analytics and studies in order to improve the Platform, products and services we provide.

External Third Parties

We may share your personal information with external third parties, such as:

  • in order to maintain the Platforms and the ancillary support that the Platforms require;
  • service providers or vendors who under contract assist us with our business operations;
  • with the Service Providers or Users of the Platforms, as necessary, for you to connect as provided for by the Platform;
  • as we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganisation, dissolution or similar event, personal information may be part of the transferred assets;
  • in terms of SweepSouth’s legal obligations to do so. In which case, SweepSouth may disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to:
    • comply with a legal obligation;
    • protect and defend the rights or property of SweepSouth;
    • act in urgent circumstances to protect the personal safety of users of the Platform or the public; or
    • protect against legal liability.

SECURITY

SweepSouth takes reasonable and industry standard steps to protect your personal information from loss, misuse, and unauthorised access, disclosure, alteration, or destruction. Further, SweepSouth takes all reasonable measures to ensure that every third party involved in the processing of your personal information has the required organizational and technical protections in place, including the required data processing and transfer agreements where this is necessary. When required under applicable law, we may provide you with a list of our operators or suppliers upon request, by contacting us at support@sweepsouth.com.

It should be noted however, that no internet or e-mail transmission is ever fully secure or error free, any transmission is at your own risk. In particular, e-mail sent to or from the Platforms may not be secure. Therefore, you should take special care in deciding what information you send to us or disclose on the Platform. Please keep this in mind when disclosing any personal information to SweepSouth via the internet. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

SweepSouth undertakes that it has taken all reasonable precautions to secure the payment processing that is carried out to receive payment for Platform and Services on it. SweepSouth cannot be held responsible for security breaches occurring on your electronic device (personal computer or other electronic device used to access the Platform), which may result due to the lack of adequate virus protection software or spyware that you may inadvertently have installed on your device.

Registered SweepSouth users will have an account name and password that enables you to access certain parts of the Platform. You are advised to change your password upon registration and are responsible for keeping them confidential. Please don’t share them with anyone.

STORAGE AND INTERNATIONAL DATA TRANSFERS

SweepSouth may store such information itself or such information may be included in databases owned and maintained by SweepSouth’s affiliates, agents or service providers. SweepSouth may retain your personal information for as long as required for the fulfilment of the purposes for which we collected it and in terms of any applicable law.

In addition, if we have service providers who are cross border or use systems cross border, it may be required to transfer and share personal information cross-borders.

We will only share information cross border with recipients who have laws similar to POPI which apply to them, or who entered into an agreement with us which includes the applicable data protection requirements in terms of law.

MARKETING AND ADVERTISING

SweepSouth and its affiliates may use personal information to contact you in the future to tell you about services we believe will be of interest to you, provided you have consented to such marketing. Such marketing will occur if you have:

  • requested more information from us;
  • subscribed to the Platform;
  • entered into a promotion campaign, offer or survey or loyalty programme, offered by SweepSouth or with other third parties it has elected to work with, and provided your contact details to participate in such activity.

If we do send marketing, each communication we send you will contain instructions permitting you to “opt-out” of receiving future communications, which you may do so at any time. In addition, if at any time you wish not to receive any future communications or you wish to have your name deleted from our mailing lists, please contact us as indicated.

We do not disclose personal information about identifiable individuals to advertisers, but we may provide them with aggregate and/or anonymised information about our users to help advertisers reach the kind of audience they want to target. We may make use of the information we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to that target audience.

USE OF COOKIES

In operating the Platforms, we may use a technology called “cookies.” SweepSouth utilises first and third party cookies. This enables us to:

  • improve your experience on the Platform or website through various means such as storing preferences or determining aggregate usage behaviour (time on site, number of pages viewed etc.) through web analytics tools like Google Analytics.
  • provide more relevant Display Advertising to users who have visited the website, using third party tools such as, but not limited to, Google Analytics Remarketing, Google Display Network Impression Reporting and Google Analytics Demographics and Interest Reporting.

Cookie Opt-out

Most web browsers provide the option to block some or all cookie types should you wish to. Users can also opt out of the Google Display Network using the Ads Preferences Manager. Because many of our Website’s features utilise cookies, we recommend that you do not block them.

YOUR RIGHTS

You have the following rights:

  • access to your personal information;
  • correct or rectify your personal information;
  • delete your personal information;
  • withdraw your consent to SweepSouth to process your personal information;
  • restrict the processing of your personal information; and
  • raise a complaint about how your personal information is being processed.

You may email us at support@sweepsouth.com to exercise any of the above rights. We will use commercially reasonable efforts to honour your request. We may retain an archived copy of your records as required by law or for legitimate business purposes (and if so we will explain this to you at the time).

Should you have any complaints about how Sweepsouth uses your personal information you are entitled to contact the Information Regulator to lodge a complaint. Such complaints can be directed to:

CHILDREN

SweepSouth does not knowingly collect personal information from children (individuals under the age of 18). If you are under the age of 18, please do not submit any personal information through the Platforms and you may not use the Platforms.

We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide personal information on the Platforms without their permission.

If you have reason to believe that a child under the age of 18 has provided personal information to SweepSouth through the Platforms, please contact us, and we will endeavor to delete that information from our databases.

IMPORTANT TO NOTE

Links to Other Websites

This Privacy Policy applies only to the Platforms. The Platforms may contain links to other web sites, platforms or applications not operated or controlled by SweepSouth (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. Third Party Sites are governed by their own privacy policies and terms and conditions and you shall be governed by them should you enter Third Party Sites. The links from the Platforms do not imply that SweepSouth endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

Customer Details

Customer details will be stored by SweepSouth separately from card details.

Gift Vouchers

SweepSouth Gift Vouchers and Coupons are not redeemable for cash and will not be replaced if lost, stolen, destroyed or used without permission. SweepSouth Gift Vouchers and Coupons cannot be resold to or exchanged with a third party. SweepSouth Gift Vouchers and Coupons can only be redeemed online through it’s Platform or through other official means.

Other Terms and Conditions

Your access to and use of the Platform is also subject to the Terms of Use at sweepsouth.com/terms.

Changes to SweepSouth’s Privacy Policy

The Platform and our business may change from time to time. As a result, at times it may be necessary for SweepSouth to make changes to this Privacy Policy. Therefore, we may update this privacy policy from time to time (for example, to reflect changes in our business or the law). Any changes we may make will be posted on this page and we will highlight to you any material changes which we make. This Privacy Policy was last updated on the date indicated above. Your continued use of the Platform after any changes or revisions to this Privacy Policy shall indicate your agreement with the revised terms.

LEGAL STATUS

In terms of POPI, we are the responsible party regarding use of the Platforms.
